Vista Prostate Health Assessment

1.    These Terms

1.1  These terms and conditions are the “General Terms” which apply to every promotion (“each a ‘Promotion”) that InHealth Limited (trading as Vista Health) (“Vista Health”) administers.

1.2  Each Promotion may also have its own specific terms and conditions (“Specific Terms”), which if applicable, will be set out below these General Terms.

1.3  These General Terms shall apply in addition to any Specific Terms. You should always read these General Terms together with the Specific Terms.

1.4  Where an individual books a Vista Health diagnostic service through a Promotion, that individual will also be subject to the Vista Health General Patient Terms and Conditions (“General Patient Terms”) which can be accessed at vista-health-private-patient-terms-and-conditions-updated-september-2024.pdf.

1.5  If any provisions in the Specific Terms conflict with these General Terms or the General Patient Terms, the order of deference will be as follows:

1.6  We may change these General Terms at any time so you should check this page regularly for any changes. Changes will apply from the date that they are published on this page.

1.7  By using any Promotion, you accept that you will be bound by these General Terms, any applicable Specific Terms, and if applicable, the General Patient Terms).  

 

2.    The Promoter

2.1  The ‘Promoter’ of a promotion is the party legally responsible for administering it. For our Promotions, this will be InHealth Limited (company registration number 05190234), trading as Vista Health, a company registered in England and Wales, with registered offices at Beechwood Hall, Kingsmead Road, High Wycombe, Buckinghamshire, HP11 1JL.

 

3.    Eligibility Rules

3.1  Unless Specific Terms state otherwise, our Promotions are open to all residents living in England, Scotland and Wales, aged 40 years or over.

3.2  Some Promotions may have a number of additional eligibility requirements and limits, which will be detailed in the Specific Terms.

3.3  Whether all relevant eligibility requirements have been met, will always be decided in Vista Health’s sole discretion and we may require evidence of confirmation from entrants before they can access a Promotion.

3.4  Employees of Vista Health or a group company of InHealth Limited (as defined in section 1159 of the Companies Act 2006) members of their direct families, or any person directly associated with a Promotion are not eligible to use this promotion. Any attempts to use the promotion by such persons will be invalid.

 

4.    Using Vista Promotions

4.1  Unless stated otherwise in the Specific Terms, Promotions are limited to one use/application per person and individuals may not use the promotion on behalf of another person, group company or syndicate. Entrants must use their legal name.

4.2  Vista Health takes no responsibility for any technical, communication or other problems that might prevent an individual being able to access a promotion. We cannot enter into correspondence with entrants who experience difficulties with the entry mechanism.

 

5.    Publicity and Personal Information

6.1   All personal information provided by entrants when accessing a Promotion will be used by Vista Health for the purposes of administering and fulfilling the Promotions and always in accordance with the Vista Health Privacy Policy which can be accessed here: Privacy policy :: Vista Health (vista-health.co.uk).

6.2  Where, as part of entering a Promotion you have stated that you want to receive communications from Vista Health about our promotions, special offers and services:

6.2.1     Your email address will be added to our electronic mailing list accordingly;

6.2.2     Any personal data you provide will be processed in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and associated laws;

6.2.3     The way in which your data will be processed by Vista Health will be in accordance with the Vista Health Privacy Policy, linked above;

6.2.4     If you do not wish for the use of your details for marketing purposes at any time, you can select the unsubscribe option in the emails that are sent to you.

 

6.    General

7.1  Vista Health reserves the right to prevent any individual who it reasonably believes violates these General Terms or any Specific Terms, from usings the Promotion.

7.2  Vista Health may vary these General Terms or any Specific Terms or terminate a Promotion at any time at our absolute discretion if it is reasonably required to do so.

7.3  Termination or variation of a Promotion is without any liability to any individual.

7.4  All decisions made by Vista Health in relation to a Promotion are final.

7.5  A failure by Vista Health to enforce any of the terms and conditions in the General Terms or Specific Terms in any instance will not give rise to any claim or right of action by any individual, nor shall it be deemed to be a waiver of any of Vista Health’s rights in relation to the same.

7.6  Except as specifically set out within the terms and conditions contained within these General Terms and any Specific Terms, all conditions, warranties and representations expressed or implied by law are excluded to the maximum extent permitted by law.

7.7  In the event that any provision of these General Terms or any Specific Terms are held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions which shall continue in full force and effect.

7.8  Nothing in these terms shall exclude or limit Vista Health’s liability for death or personal injury caused by our staff’s negligence or fraud, or for any other liability which cannot be excluded by law or regulation.

7.9  Vista Health cannot guarantee that the services or systems for entering a Promotion will at all times be free from errors or omissions, nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily without notice and in the case of any problem with any network or line, system, server, software, or for reasons reasonably beyond our control. We do not accept responsibility where all or any part of the service relating to a Promotion is discontinued, modified or changed in any way.

7.10       Our Promotions are not sponsored, endorsed or administered by, or associated with any social media platforms, including but not limited to, LinkedIn. Individuals agree to abide by the terms of service of those platform providers when accessing a Promotion published on social media and further agree to release the social media site(s) from any liability arising from or as a result of any participation in such Promotion.

7.11       These General Terms and any Specific Terms shall be construed in accordance with and governed by the laws of England and Wales.

7.12       Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.

 

Specific Terms for the Times Newspaper Men’s Prostate Health Assessment Promotion (“Times Promotion”)

1.    The Times Promotion entitles individuals to a £199 discount off the standard price of a Prostate Health Assessment with Vista. The full price for a PCC can be accessed at https://www.vista-health.co.uk/health-screenings/prostate-health-assessment/

1.1  The promotional discount can be redeemed by:

1.1.1  Telephoning the Vista Health Patient Experience Centre on the number provided on the Promotion.

1.1.2     Accessing the Vista Health website using the web address provided on the Promotion.

1.1.3     Using your smartphone to scan the QR code provided on the Promotion; and quoting the discount code.

2      This Promotion is valid until:

2.1   23.59.59 hours on 17 March 2025, if booking via the Vista Health website; or

2.2   8pm on 17 March 2025 if booking by telephone.

3      The Promotion cannot be used in conjunction with any other promotions or discounts.

4. The offer has no cash alternative and is non-transferable.

5      The offer is only valid for a Prostate Health Assessment and cannot be applied to other diagnostic services that Vista Health offers.

6      The offer is valid for self-pay customers only and cannot be used through private medical insurance.

7      The promotion is subject to availability and appointments must be booked in advance.
