General Terms and Conditions for Prize Draws at Vista Health

Employee Health Assessments Competition Terms and Conditions

1.    These Terms

1.1 These terms and conditions are the “General Terms” which apply to every prize draw promotion (“each a ‘Promotion”) that InHealth Limited (trading as Vista Health) administers.

1.2 Each Promotion may also have its own specific terms and conditions (“Specific Terms”), which if applicable, will be set out below these General Terms.

1.3 These General Terms shall apply in addition to any Specific Terms. You should always read these General Terms together with the Specific Terms. If any provisions in the Specific Terms conflict with these General Terms, the Specific Terms will prevail.

1.4 We may change these General Terms at any time so you should check this page regularly for any changes. Changes will apply from the date that they are published on this page.

1.5 By entering any Promotion, you accept that you will be bound by these General Terms and any applicable Specific Terms.

 

2.    The Promoter

2.1 The ‘Promoter’ of a prize draw promotion is the party legally responsible for administering it. For our Promotions, this will be InHealth Limited (company registration number 05190234), trading as Vista Health, a company registered in England and Wales, with registered offices at Beechwood Hall, Kingsmead Road, High Wycombe, Buckinghamshire, HP11 1JL.

 

3.    Eligibility Rules

3.1 Unless Specific Terms state otherwise, our Promotions are open to all residents living in England, Scotland and Wales, aged 18 years or over.

3.2 Some Promotions may have a number of additional eligibility requirements and limits, which will be detailed in the Specific Terms.

3.3 Whether all relevant eligibility requirements have been met, will always be decided in Vista Health’s sole discretion and we may require evidence of confirmation from entrants before we award a prize.

3.4 Employees of Vista Health or a group company of InHealth Limited (as defined in section 1159 of the Companies Act 2006) members of their direct families, or any person directly associated with a Promotion are not eligible to enter. Any entries submitted by such persons will be invalid.

 

4.    Entry

4.1 No purchase of any Vista Health service is necessary to enter a Promotion, unless stated differently in the Specific Terms.

4.2 Unless stated otherwise in the Specific Terms, Promotions are limited to one entry per person and entrants may not enter on behalf of another person, group company or syndicate. Entrants must use their legal name.

4.3 Vista Health takes no responsibility for any technical, communication or other problems that might prevent the receipt of the entrant’s details. We cannot enter into correspondence with entrants who experience difficulties with the entry mechanism.

 

5.    Winning and Prizes

5.1 Vista Health reserves the right to replace any part of a stated prize for an alternative prize of equal or greater value. Prizes cannot be transferred and have no cash alternative.

5.2 The prize winner of a Promotion will be chosen by random draw from all the valid entries for that Promotion, within 7 days of the closing date for entries, as set out in the Specific Terms, or such other time period as identified within the Specific Terms.

5.3 Prize winners will be notified that they have won within 28 days of the date on which the relevant draw has taken place, unless otherwise specified within the Specific Terms.

5.4 Unless specified within the Specific Terms prize winners will be notified via the email address they provided when entering the Promotion.

5.5  If Vista Health is unable to contact a winner to award a prize within 28 days of the draw, or other time period specified within the Specific Terms, (for example where the email address, or other means of contact provided for by the entrant  in the Specific Terms is invalid),  the winner forfeits their right to the prize and Vista Health reserves the right to pick another winner at random from the remaining entries.

5.6 Prize winners must claim their prize within 14 days of being notified that they have won a prize, or other time frame set out within the Specific Terms. If the prize winner fails to respond within the required timeframe, they forfeit their right to the prize and Vista Health reserves the right to pick another winner at random, from the remaining entries.

5.7 Information regarding a prize will only be sent to the email address, or other form of contact provided in the Specific Terms, provided by a prize winner. Should a prize winner’s contact details change, it is their responsibility to notify us.

5.8 We reserve the right to request proof of a prize winner’s identify in an official form (including but not limited to a driving licence or passport), and proof of address in the form of a utility bill dated within the last three months. In the event that a prize winner cannot provide Vista Health with proof of identity and/ or address that is reasonably acceptable, Vista Health may withdraw the prize and pick another winner at random from the remaining entries. 

5.9 Vista Health makes no representation or warranty in relation to any of the prizes provided and we accept no responsibility for any loss, expense or damage which is suffered or sustained in connection with a Promotion, or accepting or using any part of a prize, expect for any liability which cannot be excluded by law.

5.10 Vista Health shall not be responsible for any additional expenses incurred by a prize winner in relation to a Promotion or Prize.

 

6.    Publicity and Personal Information

6.1 All personal information provided by entrants when entering a Promotion will be used by Vista Health for the purposes of administering and fulfilling the Promotions and always in accordance with the Vista Health Privacy Policy which can be accessed here: Privacy policy :: Vista Health (vista-health.co.uk).

6.2 Where, as part of entering a Promotion you have stated that you want to receive communications from Vista Health about our promotions, special offers and services:

6.2.1 Your email address will be added to our electronic mailing list accordingly;

6.2.2 Any personal data you provide will be processed in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and associated laws;

6.2.3 The way in which your data will be processed by Vista Health will be in accordance with the Vista Health Privacy Policy, linked above;

6.2.4 If you do not wish for the use of your details for marketing purposes at any time, you can select the unsubscribe option in the emails that are sent to you.

6.2.5 Under the Advertising Standards Authority (ASA) requirements, Vista Health must either publish or make available information that indicates that a valid award took place. To comply with this obligation, Vista Health will send the surname and county of a prize winner to anyone who contacts Vista Health using the details set out in the Specific Terms within 28 days of the closing date of a Promotion. If a prize winner objects to their surname and/or county being published or made available, they should notify Vista Health of this when responding to the notification email to claim their prize. In some circumstances Vista Health must still provide the information to the ASA if requested. 

6.2.6 A prize winner may be required to participate in reasonable publicity arising out of a Promotion. 

 

7.    General

7.1 Vista Health reserves the right to disqualify any entrant who it reasonably believes violates these General Terms or any Specific Terms.

7.2  If for any reason any Promotion is not capable of running as planned as a result of, but not limited to technical failures, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond the control of Vista Health which corrupt or affect the administration, security, fairness, integrity, or proper conduct of a Promotion, we reserve the right to cancel, modify or suspend the Promotion and/or to disqualify any individual who (whether directly or indirectly) causes or has caused the problem.

7.3 Vista Health may vary these General Terms or any Specific Terms or terminate a Promotion at any time at our absolute discretion if reasonably required to do so. Termination or variation of a Promotion is without any liability to any entrant or other person. If the Promotion is terminated Vista Health will not award the prize.

7.4 All decisions made by Vista Health in relation to a Promotion are final.

7.5 A failure by Vista Health to enforce any of the terms and conditions in the General Terms or Specific Terms in any instance will not give rise to any claim or right of action by any entrant or prize winner, nor shall it be deemed to be a waiver of any of Vista Health’s rights in relation to the same.

7.6 Except as specifically set out within the terms and conditions contained within these General Terms and any Specific Terms, all conditions, warranties and representations expressed or implied by law are excluded to the maximum extent permitted by law.

7.7 In the event that any provision of these General Terms or any Specific Terms are held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions which shall continue in full force and effect.

7.8 Nothing in these terms shall exclude or limit Vista Health’s liability for death or personal injury caused by our staff’s negligence or fraud, or for any other liability which cannot be excluded by law or regulation.

7.9 Vista Health cannot guarantee that the services or systems for entering a Promotion will at all times be free from errors or omissions, nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily without notice and in the case of any problem with any network or line, system, server, software, or for reasons reasonably beyond our control. We do not accept responsibility where all or any part of the service relating to a Competition is discontinued, modified or changed in any way.

7.10 Our Promotions are not sponsored, endorsed or administered by, or associated with any social media platforms, including but not limited to, LinkedIn. Entrants agree to abide by the terms of service of those platform providers when entering a Promotion published on social media, and further agree to release the social media site(s) from any liability arising from or as a result of any participation in such Promotion.

7.11 These General Terms and any Specific Terms shall be construed in accordance with and governed by the laws of England and Wales.

7.12 Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.

 

 

Specific Terms 

1.    How to enter

1.2 In order to enter this Promotion entrants must:

1.2.1 Click on the link and complete the questionnaire identified within the Vista Health LinkedIn post;

1.2.2 Share the Vista Health post to your own/your company’s LinkedIn page.

1.3. Comment on the post with your company name

1.4 Entrants can enter the Promotion from 12.00.01 hours on 18th September until 23.59.59 hours on 31st October 2024.

 

2.    Promotional Prize

2.1 The winner will receive a maximum of 5 Vista Woman or Vista Man Assessments (an “Assessment”) to be used by up to five employees within your company or the company you work for. A link to our Vista Assessments generally, as well as what is included within a Vista Man or Vista Woman Assessment can be accessed here.

3.    Eligibility

3.1 Entrants may be either a company director or a company employee. An employee does not require the permission of their employer to enter this Promotion. If the prize is won by a Company director, they may select at their discretion, up to 5 employees who may utilize the prize. If an employee of a company wins the prize they may utilize one of the abovementioned Assessments themselves. The employee must however liaise with persons of appropriate authority at the company they work for, to enable up to four other consenting employees to also access an Assessment.

3.2 As part of this Promotion an individual can only access one free Assessment.

3.3 In some circumstances an individual may be restricted from accessing some services included within an Assessment (for example but not limited MRI scans) due to certain pre-existing health conditions or factors such as weight limits. If any of these restrictions apply to a prize winner Vista Health will offer an alternative service, of equal value to the prize winner. Which alternative service offered is at the sole direction of Vista Health.

3.5 All of the Assessments booked as a result of winning this Promotion must be booked with Vista Health within 6 months of the date on which the winning entrant was notified by Vista Health.
